TERMS & CONDITIONS

Please read carefully.  Be sure to retain your copy for your records, as these policies will be strictly followed, and exceptions or changes cannot be made for any reason.

Registration Fee: 

  • Registration fee, if registered before 25 January is R500.
     If registered after 31 January, registration fee is R600.
    Registration fee includes your 2026 TADA membership,  competition/exam cloth number.
  • These fees are not refundable.

Cancellation: 

  • Cancellation is only possible between 1 February and 31 October.
  • This agreement is valid from date of registration until 31 December 2026.
  • If for any reason the need arises for cancellation of contract, a cancellation fee of R 1000.00 will be payable per dancer. Please email your cancellation notice to Top Form Dance Company at topformdance@gmail.com. 
  • Verbal or telephone notice to an instructor/agent/assistant/member or to the office WILL NOT be accepted. 
  • Cancellation is immediately effective on receipt of the cancellation form, accompanied by the cancellation fee, and all outstanding dance fees.  
  • In case of cancellation, where the proper cancellation steps as explained above, have not been completed, the parent/guardian/member will be liable for all fees, to the full terms of this agreement.

Tuition & Fee's: 

  • As Guardian/Parent of the registered student,  you will be responsibility for all tuition; for all months from date of registration;  through to December 31st, 2026.
  • Tuition as listed below, as well as under the Timetable section of this website, is agreed upon for the selected level, until this agreement expires on 31 December 2026.
  • Tuition is paid in advance of the dance month. 
  • Private lessons must be paid on reservation before your class. Private lesson cost R450 per hour. 
  • Training will be provided for examination and competing in Classic, Latin and Extreme Styles.  Monthly fee includes two lessons per week of 45 min each.  Monthly fee also includes all extra group practices that might be scheduled in preparation for regional and national competitions, extra concert practices and exams, but is excluding of private lessons, exam fees and workshop fees.
  • A  re-registration fee of R300 will be repayable, should a student withdraw/cancel and return at any time thereafter, in the same year. 
  • Monthly fees are payable before the 4th of each month.   
  • Should two month's fees be outstanding and  no arrangement was made for outstanding fees, we will proceed with legal action and dance lessons will be suspended until accounts are up to date.
  • Dancers will not be allowed to participate in workshops, competitions, eisteddfods, festivals, or exams, if there is an outstanding amount on your account.
  • All entry fees must be received at least two days before the entry closing date, to be entered for the event. 
  • The guardian/parent will be held liable for all outstanding fees, as well as interest and legal fees.
  • There will be no refunds for any reason.

Indemnity:
By completing the registration process, as a parent/guardian, 
  • I hereby declare that I shall not hold Top Form Dance Company or it’s dance instructors liable for any damage or injury, sustained by the member or child whilst the member or child is involved in practice, travel with studio/instructors to an away course, competition or show.  As well as participation in any competition or show arranged by the dance instructor or Top Form Dance Company.
  • I undertake to indemnify Top Form Dance Company and any of its dance teachers and or instructors against any and all claims by me/on behalf of my child and or any third parties arising from any cause of action whatsoever, as a result of any injuries sustained or loss or any damage consequent to the member or his property, during the course of normal dance lessons and or any dance competitions and shows as arranged through Top Form Dance Company at provincial, regional, national or international level. 
  • I understand that Top Form Dance Academy only employes qualified coaches, and accept that the Dance teacher will take every reasonable precaution to ensure the safety of myself/my child whilst the member/child is inside the studio.                                                                                                                                       
​Non-variation:
  • The policies of Top Form Dance Company will not change. Jouney-Anne Steenkamp, dance instructors or assistants cannot make exceptions, as these policies are set in place to ensure the smooth and professional operation of Top Form Dance Company.
  • The agreement constitutes the whole of the agreement between the parties and no amendment, alteration, variation or consensual will be of any force or effect unless reduced to writing and signed by both parties.                      
​Legal:
  • If Top Form Dance Company deems it necessary to proceed with legal action for nonpayment of any amount as stated in the above agreement or any other reason, the guardian/parent will be responsible for all legal costs on Attorney and client scale. 
  • The Guardian/parent choose the domicilium citandi et executandi of any action arising out or in connection with this agreement at the address as stated as in the registration document, at which all notices, letter of demand and all communication will be sent.

Conditions:

  • Top Form Dance Company, shall always, have the right to increase membership fees and/ or change the time schedule of the classes. 
  • Classes need to have 4 enrolled dancers to run.  Classes with less than 4 dancers will be combined with other age groups and classes or cancelled.
  • The dance instructor will not assume responsibility for the member and or your child for the time prior to and after the dance lesson, as the dance instructor will be busy teaching other dancers in the next class.  Students are to be collected from inside the studio. The studio and teachers will take no responsibility for those who wait outside to be collected.
  • A respectful code of conduct to be carried by both parties. Dancers and parents will be held responsible for the negative slander or bullying verbally to our own or other dancers, or on social media, and the studio. This type of behavour is at discretion to terminate contract immediately if the code of conduct is not adhered to.
  • The liability to make payment of membership fees shall not be suspended by temporary absence from classes of a member for whatsoever reasons. 
  • The parent/guardian is liable to pay Top Form dance Company on demand for any damage done to the studio or property in whatsoever manner by the member/parent/guardian and any other persons brought onto the premises by the member/parent/guardian. 
  • Top Form Dance Company will be closed during school holidays.  These dates are listed under the Timetable section of our website.
  • There will not be lessons on public holidays.  These dates are listed under the Timetable section of our website. 
  • TADA syllabus is copyrighted, and only registered teachers can teach these works. Syllabus routines cannot be used in any group performances e.g. talent competitions, school reviews, cheerleading’s, eisteddfods etc. without the written permission from the TADA Head office, unless all participating dancers are registerd with TADA. These works can only be performed by registered students and at TADA competitions, exams and within the classes of current registered qualified teachers of the style being performed.
  • Dancers will not be allowed to participate in any competitions, exams, or concerts if there is an outstanding balance on the account.
  • The preferred method of payment for competitions/eisteddfod/exams is electronic transfer.

During the year, photos of the dancer may be taken during class or performances. These photos may be used for publicity for the studio in either newspaper advertisements; may appear on our social media or websites. We take our students safety very seriously and will never include names when displaying photos publicly, except for achievement sections in newspapers.

However, you may opt to not have your child's photo displayed publicly by sending us a message or email.
 
By completing registration with Top Form Dance Company, you agree to be bound by the conditions of this agreement.  This means that you have read, understood, and agreed to abide by all the studio policies while attending classes at Top Form Dance Company. 
 
We reserve the right to refuse service and terminate enrollment. We reserve the right to increase fees according to inflation.
